The hill in this case, which was filed by the appellant, seeks to set aside a deed of assignment for the benefit of creditors. *846made by tbe appellee, John W. Augustus to John L. Lee and Volney E. Howard, trustees, on tbe first day of April, 1903, upon tbe ground that it was fraudulent both in fact and in law, and was made with intent to hinder, delay and defraud the creditors of the grantor.

A mass of evidence was taken in an attempt to support the •allegation of fraud in fact, but by the decree appealed from this charge was held not to be sustained, and the deed was declared also to be not…
