This is an appeal from a judgment and sentence for the crime of murder in the first degree.

On December 1, 1961, at approximately 6:50 a.m., a tall, slim man driving a light-colored 1957 Pontiac, with an out-of-state license, drove into a service station on First Avenue South in Seattle, Washington. He parked his car between the plate glass window and the gas pumps at the front of the station.
