Taylor v. State

Court of Appeals of Georgia

1Opinion of the Court

MILLER, Chief Judge.

A Gwinnett County jury convicted Brian Taylor of aggravated assault (OCGA § 16-5-21 (a) (2)) and armed robbery (OCGA § 16-8-41). Taylor appeals following the denial of his motion for a new trial, arguing that (1) the trial court erred in failing to merge the aggravated assault and armed robbery counts and (2) his trial counsel was ineffective. Concluding that the trial court should have merged the armed robbery and aggravated assault counts but otherwise discerning no error, we affirm Taylor’s convictions but vacate the judgment in part and remand for resentencing.
