The defendant is a physician. A patient upon whom he performed an abortion died as a result of the operation. He was charged with manslaughter, of which crime a jury found him guilty. He appeals from judgment and sentence on the verdict.
Appellant did not take the witness stand. The state produced several witnesses who testified as to statements made by appellant upon his being taken into custody shortly after the death of his patient.
