In this personal injury case, plaintiff brought an action against defendant school district for injuries sustained in a fight on school grounds during lunch period. A jury returned a verdict in favor of defendant on the ground that defendant was not negligent. The trial court entered judgment for defendant. The Court of Appeals affirmed in part, reversed in part, and remanded the case for a new trial. Mosley v. Portland School Dist. No. 1J, 108 Or App 7, 813 P2d 71 (1991). We allowed review and now reinstate the judgment of the circuit court.
