The judges of the Court of Appeal for the First Circuit, availing themselves of the provisions of section 25 of article 7 of the Constitution (1921), have asked for instruction on a question of law. The question is whether, in a tort action, which is subject to the prescription of one year, the filing of the suit and serving of the citation on the next day after the year has *635expired will interrupt prescription, when the last day of the year was Sunday.
