O’NIELL, Chief Justice.

This is a concursus proceeding, brought by Kelly, Weber & Co., Inc., a furnisher of materials used in the construction of a state highway. The defendants are F. D. Harvey & Co., Inc., contractor; the Union Indemnity Company, surety on the contractor’s bond; and the Louisiana Highway Commission, builder of the project. The plaintiff stated in the petition the names of several parties who had recorded claims for labor or materials furnished for the construction of the highway, and prayed that they should be cited to appear and assert their claims.
