This matter is before the Court on the record of a State due process hearing and evidence taken ore terms in the action filed by JP, a twelve year old autistic boy, and his parents (collectively “the parents”) seeking, under 20 U.S.C. § 1415(i)(2)(a) of the Individuals with Disabilities Education Act (“IDEA”), 20 U.S.C. § 1400 et seq., to overturn the October 14, 2005 decision of a State Hearing Officer.
