Pending before the Court is plaintiff Texas Commerce Bank National Association, Trustee’s (“Texas Commerce”) Motion for Partial Summary Judgment (Instrument #27) and defendant United States of America’s Cross Motion for Partial Summary Judgment (Instrument #29).
