MEMORANDUM OF DECISION

This is an administrative appeal by the plaintiff, Robert Fromer, from a final decision by the Commissioner of the Department of Environmental Protection ("Department"). The Commissioner served as a hearing officer in reviewing an application brought by the Department of Economic and Community Development ("DECD") for an exemption under the provisions of the environmental laws governing flood management.
