The defendant, along with a number of other individuals, was sought by the F.B.I. because of his suspected involvement in a bank robbery. Two days after the robbery defendant was riding in an automobile driven by Gene Henry, who was also believed to have been involved in the robbery. The car was stopped by F.B.I. agents. Henry, apparently in an attempt to escape, rapidly accelerated the car toward some of the F. B.I. agents. Shots were fired into the car, and Henry was killed.
