OPINION

NUCHIA, Justice.

Appellant, Robert Norman Bousquet, was convicted by a jury of indecency with a child. The jury, after a finding of true to one enhancement paragraph, assessed punishment at 42 years confinement and a $5000 fine. In this appeal, appellant raises the following points of error: (1) the admission of the child complainant’s videotaped statement violated appellant’s federal constitutional right to confront and cross-examine the complainant; (2) the trial judge erred when she determined that complainant was unavailable for the purpose of admitting hearsay statements under…
