Appeal by the defendants, the Bidgway-Thayer Company and others, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the cleric of the county of New York on the loth day of December, 1906', upon the decision of the court, rendered after a trial at the New York Special Term, overruling the defendants’ demurrer to the complaint.

Laughlin, J.:
This is an action for libel. The ground of the demurrer is that the facts alleged do not constitute a cause of action. No special damages are alleged. The question, presented by the demurrer is whether the article alleged to have been published of and concerning the plaintiff is libelous per se.
