This matter is before the court on a motion for summary judgment by the creditor-plaintiff, Ford Motor Credit Company (hereinafter Ford). In its moving papers Ford requests an order pursuant to Rule 56 of the Federal Rules of Civil Procedure and Rule 756 of the Rules of Bankruptcy Procedure granting judgment in its favor on two of four causes of action found in a complaint duly served by it on the debtor-defendant, John D.
