On May 19, 1988, a jury, in the district court for Buffalo County, convicted Clair Juhl of felonious theft. See Neb. Rev. Stat. § 28-511(1) (Reissue 1985) (theft by unlawful taking) and Neb. Rev. Stat. § 28-518(2) (Reissue 1985) (grading of theft offenses; property valued at more than $300, but less than $1,000). Later, after receiving evidence at a hearing concerning Juhl’s prior felony convictions, the district court determined that Juhl was a habitual criminal and sentenced Juhl to imprisonment for not less than 10 nor more than 20 years, pursuant to Nebraska’s habitual criminal act, Neb.…
