FRUGÉ, Judge.

Suit was filed by plaintiff, Wallace Vid-rine, against New Amsterdam Casualty Company, the workmen’s compensation carrier of plaintiff’s employer, Deo Fruge. The plaintiff seeks workmen’s compensation benefits for total and permanent disability which resulted from his contracting tuberculosis during the course and scope of his employment. A motion for summary judgment was filed March 30, 1961 by the defendant, on May 9, 1961 the trial court rendered judgment over-ruling the motion for summary judgment.
