THIS MATTER is before the Court upon Magistrate Judge Lynch’s Report and Recommendation (“R & R”) [DE 31], Plaintiffs objection thereto [DE 32], Defendant’s response [DE 33], and Plaintiffs notice of supplemental authority [DE 35]. The R & R recommends granting Defendant’s Motion to Dismiss [DE 11] with prejudice.
