This action is brought by the plaintiff against the defendant, a surety company, upon a bond given by the said defendant as surety for one Antonio Crisafi, who conducted a steamship ticket agency in the city of New York. The action is brought to recover damages sustained by the plaintiff by reason of his having deposited certain money with Antonio Crisafi for transmission to foreign countries and which he failed to do.
