This matter is before the court on plaintiff Northern Natural Gas Company’s Motion to Confirm Condemnation Authority (Doc. 5). The owners of various defendant tracts have filed responses opposing the motion (Docs. 116, 117, 118, 122, 123 and 125).
Northern’s motion is based on a Certificate of Public Convenience and Necessity issued by the Federal Energy Regulatory Commission (FERC) on June 2, 2010. Asserting a right to condemn the defendant property pursuant to the FERC Certifi cate and the Natural Gas Act, 15 U.S.C. § 717 et seq.,…
