This suit was brought by the appellee against the appellant, and the first paragraph of the complaint is as follows:
“ Alonzo Blair, administrator of the estate of Homer Palmerton, deceased, plaintiff, complains of Edward Norris, defendant, and says that heretofore, to wit, at Shelby county, Indiana, on the first day of December, A. D. 1869, the said decedent, being then and there in life, was the owner and in possession of a large quantity of wheat, then and there remaining in bins and granaries, to wit, one thousand bushels, and being such owner of a large amount of other personal property,…
