This Court granted certiorari to review the denial of Charles W. Patrick’s (“Petitioner”) application for Post Conviction Relief (“PCR”).

Factual/Procedural Background

Petitioner was originally indicted in 1975 for burglary, two counts of armed robbery, assault and battery with intent to kill, and the use of a motor vehicle without the owner’s consent. All the indictments, except the burglary indictment, were nol prossed prior to trial. After a trial in March 1976, Petitioner was convicted of burglary and sentenced to life in prison.
