The named plaintiff, Assurance Company of America (Assurance), is the subrogee of the coplaintiff, KLM Rentals, Inc. (KLM). The named defendant, Andrew M. Yakemore, developed, operated and constructed two acres of commercial premises in Simsbury where KLM leased space. The plaintiffs allege that the named defendant, in August, 1983, submitted building plans to the town of Simsbury (town) and sometime in September, 1984, applied to the town for a building permit.
