MEMORANDUM & ORDER
BATTIN, Senior District Judge.
Pending before Court is Defendants’ Motion for Summary Judgment. For the reasons stated below, the motion is granted.
FACTS AND PROCEDURAL BACKGROUND
Plaintiff was hired by Defendant Phelps Dodge Corporation (“Phelps”) on March 20, 1984, and worked there for over five years as a cleaning laborer. Plaintiff alleges that in 1987, Phelps was partially acquired by a Japanese company.
