This is an action for damages, brought by the First State Bank & Trust Company of Hereford, Tex., against the Western Union Telegraph Company and John Young. Plaintiff alleged that John Young caused to be delivered to the telegraph company for transmission and delivery to the plaintiff bank a forged telegram, bearing the signature of Donna Gardner. That the telegraph company negligently accepted said telegram, and thereafter delivered it to the bank, causing the bank to pay out, to its ultimate loss, certain funds on account of the said Donna Gardner.
