Although orders under various circumstances were issued in this case by each of the seven judges of the superior court of the Atlanta Circuit, the sole exception is to the refusal to sustain a motion to dismiss the plaintiff’s petition as amended, together with all the (interlocutory) petitions and orders entered by the court. As one of his bases therefor, the movant challenged the legality of the service. The petition was filed on December 6, 1938, in Fulton superior court. Norman A.
