In July, 1911, the plaintiff and her husband, John Fenlon, since deceased, entered into a contract with the New York Foundling Hospital, under which they took the care, custody and control of the defendant, Angela Rock, a female child then of the age of a little less than three years. They had no children of their own, and this child was a member of their family until the death of the said John Fenlon, which occurred about seven months thereafter, and the child has since been, and now is, in the care and custody of the plaintiff, Mary Fenlon.
