This action is the outgrowth of proceedings had in the district court of the seventh judicial district, in and for Dawson county, entitled “The State of Montana ex rel. Albert Ander*245son v. Frank Oliver and Certain Intoxicating Liquors” (No. 3526). The cause came on regularly for trial on May 3 before the court sitting without a jury. At the close of the trial The ease was dismissed, and the following entry recorded in the minutes of the court: “At this time, through his attorney, D.
