MEMORANDUM OPINION AND ORDER

This matter is pending for consideration of the defendant’s motion for summary judgment [Record No. 23], motion in li-mine [Record No. 32], and motion to exclude evidence [Record No. 33]. For the following reasons, the motion for summary judgment will be granted, in part, and denied, in part. The motion in limine and motion to exclude will be denied.
