On the trial of this case in the district court the following agreement was made:
“It is agreed that J. B. Stoker and K. Stoker were the owners of the north two hundred (200) feet of block three (3), original town of Breckenridge and entered into a surface lease on the - day of March, 1920 (acknowledgments being dated March 10, 1920), with H. C. Burch and V. E. Steen, as shown by copy of said lease attached to plaintiffs’ petition as Exhibit A; that said Burch and Steen made a surface lease on July 13, 1920, to E. S. Branch, said lease to Branch covering a strip 25 feet north and south, and…
