OPINION ON REHEARING
BLAND, Justice.
We grant rehearing and withdraw our opinion and judgment of July 3, 2008, and issue the following in their stead. We dismiss Rapid Settlements’ motion for en banc rehearing as moot. Our disposition of the case remains unchanged.
Transamerica Occidental Life Insurance Company and Transamerica Annuity Service Corporation (collectively, Trans-america) bring a restricted appeal from the trial court’s final judgment confirming an arbitration award in favor of appellee Rapid Settlements.
