Appeal by the defendants, the Mapes-Reeve Construction Company and another, from a judgment of the Supreme Court in favor of the plaintiffs, entered in the office of the clerk of the county of New York on the 23d day of September, 1902, upon the decision of the court rendered after a trial at the New York Special Term.

The action was brought to a foreclose, a mechanic’s municipal lien. On the 23d day of April, 1897, the commissioner of public works entered into a contract with appellant, the Mapes-Reeve Construction Company, pursuant to the provisions of chapter 703 of the Laws of 1894, as amended by chapter 399 of the Laws of 1895, for the ■ construction of a hospital on G-ouverneur slip.
