On February 21, 2008, Plaintiffs filed this action alleging that WellPoint Inc. (“WellPoint”) violated the Fair Labor Standards Act (“FLSA”), 29 U.S.C. § 216(b), as well as New York Labor Law §§ 650 et seq., and New York State Department of Labor Regulations, by failing to pay required overtime compensation.
