OPINION

2Per curiam

Appellant was convicted of capital murder for the shooting death of James Joe 1 in the course of a burglary, V.T.C.A.Penal Code, § 19.03(a)(2). At the punishment phase of trial, the jury returned affirmative answers to the three special issues, and appellant was sentenced to death. Article 37.071, (b) & (e), V.A.C.C.P. Appeal is automatic in this Court. Id., (h).

Although there is no challenge to the sufficiency of the evidence to support the jury’s verdict of guilt, a brief recitation of the facts of the offense will illuminate several points of error. Appellant’s cousin Gary Yon…
