NORVELL, Justice.
Texas and New Orleans Railroad Company has appealed from a judgment in favor of Billie Wood for personal injuries received by him while loading mules upon the railroad’s car at Beeville, Texas.
By its first point the railroad contends that the trial court erred in overruling its motion for a peremptory instruction. It is asserted that there is no evidence showing that appellant was guilty of negligence in failing to fulfill a duty owed by it to the appellee, Wood.
