Error from District Court, Pawnee County; Conn Linn, Judge. Action by the J. R. Watkins Medical Company against Jasper N. Lizar, A. J. Livesay, H. H. Swalley, and C. S. Platz. Judgment for plaintiff, defendants granted a new trial, and plaintiff brings error.

Plaintiff in error commenced this action against the defendants in the district court of Pawnee county, and on the 29th day of September, 1917, judgment was rendered in favor of the plaintiff against the defendants. Within the statutory time, defendants filed a motion for a new trial, which motion was, on the 9th day of October, 1917, overruled. Defendants were given an extension of time to make and serve case-made, also time within which to file supersedeas bond, which bond was thereafter, on the 9th day of November, 1917, duly filed.
