The parties hereto will be referred to as plaintiff and defendant, as they appealed in the trial court.

The plaintiff was the regular Democratic-nominee for the office of county commissioner of district No. 3 of Washington county and the defendant was the (regular Republ.-can nomin'ee for the office of county commissioner of district No. 3 of Washington county in) the general election held on the 4th day of November, 1924.
