COWEN, Circuit Judge.

Walter T. Peters (“Peters”) filed a complaint alleging that the Delaware River Port Authority of Pennsylvania and New Jersey (“DRPA”) violated his constitutional rights of freedom of belief and association by failing to reappoint him as its Secretary solely because he is a member of the New Jersey Republican Party. In a pretrial application, the district court ruled that the position of Secretary was not a politically sensitive position.
