This case involves a subrogation claim filed by Community Association Underwriters of America, Inc., (“CAUA”) seeking recovery of payments made to Park View at Waverly Condominiums (“Park View”) as a result of a fire that occurred on March 4, 2008. Before the court are *97five motions for summary judgment filed by various Defendants.
