The defendant appeals from a judgment of the Criminal Branch of the City Court of Bochester convicting him upon his plea of guilty of the crime of assault in the third degree.
It is claimed in the appeal affidavit that the judgment of conviction should be reversed in that no information was filed charging the defendant with the crime for which he stands convicted and upon the further ground that the defendant’s arrest was illegal in that no warrant was issued.
