The defendant in error, Richard Love, during the life-time of Silas Smith, instituted against 'Smith an action of ejectment in the Circuit Court for Jackson county for the recovery of the possession of the N. W. £ of the N. E-. % of section 33 in township 5 north, of range 10 west of Tallahassee meridian, containing forty acres.
