Pending in this military pay case are the parties’ cross-motions for judgment upon the administrative record. Plaintiffs motion asks the court to review two decisions of the Army Board for the Correction of Military Records (“ABCMR”). The first ABCMR decision, issued in 2000, reviewed a prior Army Board of Inquiry (“BOI”) decision which recommended that plaintiff be administratively separated due to homosexual conduct and conduct unbecoming an officer.
