The defendant was indicted and convicted for the unlawful possession of "521 plants of Marijuana, three to ten feet tall" in violation of Section 20-2-70, Code of Alabama 1975. Sentence was four years' imprisonment imposed in the following manner: three months actual imprisonment in the county jail with the remaining three years and nine months on probation.
