John Hanson Thomas was made a defendant to the complainant’s original bill in this cause, as a purchaser of parcel of the lands from the trustees, long after the complainant had purchased. It is alleged that no part of the purchase money, agreed to be paid by him, has been paid to the trustees, but was reserved in his hands, under an impression entertained both by the trustees and himself, that the trust fund, exclusive of these purchases made b}? him, would be adequate to the discharge of all the judgments of older date and lien than the judgment recovered by Thomas against the grantors, in…
