HANNA, C. J.

This is an appeal from the district court of the county of Socorro, by Jacobo Sedillo, from a conviction for murder in the second degree.

The appellant lived in the city of Socorro. He was engaged in the sheep and cattle business, and for that purpose utilized two ranches, one distant about 9y2 miles from said city, the other situate between said last-mentioned ranch and said city. The appellant made daily journeys to and from said ranches, at which times he customarily carried with him a rifle. The deceased, Antonio Gianera was also engaged in the live stock…
