Barnes instituted a suit in the Probate Court against Thomas 0. Tilghman, curator of the estate of Hardin L. *450Tilghman, in which Kirk intervened, and a judgment was rendered against the defendant for $1746 87 in favor of the intervenor. The curator, conceiving the judgment erroneous, made his application for a suspensive appeal, which was allowed, and a bond given in a sufficient sum, signed by Thomas 0. Tilghman as curator, and by the same person as surety, and also by Robert L. Tilghman. Before the record was made ont, the plaintiff objected to the security, and took a rule on the curator to…
