SARTAIN, Judge.

This litigation is concerned with a pedestrian-automobile accident in which the plaintiff, Robert Butler, was struck by a vehicle driven by Eugene Limar and insured by State Farm Mutual Automobile Co.

This collision occurred on Saturday, April 25, 1970, at approximately 7:35 p. m. on Scenic Highway in Baton Rouge. The point of collision was placed by Trooper L. B. Millet of Troop A of the Louisiana State Police at approximately twenty-eight feet north of the intersection of that highway and Stilt Street.
