This case was tried in the County • Court of Erath County on appeal from a Justice’s Court and resulted in a judgment for appellee, for the sum of $140. It was, alleged as grounds of recovery that the engine and cars of the appellant company killed two of appellee’s horses. Appellant pleaded the general denial and specially that if appellee’s animals were killed as alleged, it was within . commissioner’s precinct number 1 of Erath County, where the stock law was in force prohibiting animals from running at large, and that appellee was guilty of contributory negligence in…
