This appeal challenges the power of the Supreme Court of the State of New York, in the absence of a pending action or special proceeding, to entertain an application on motion to *309enter judgment for arrears for child support due under a separation agreement incorporated into a Mexican decree of divorce.

The parties were married on March 24, 1957 and have two children, a son, now 18, and a daughter, almost 15. On July 4, 1969, they entered into a separation agreement, the terms of which were incorporated by reference, but not merged, into a Mexican decree of…
