The plaintiff, John Furbush, appeals following a jury verdict in favor of the defendant, J. Joseph McKittrick. On appeal, the plaintiff argues that the Superior Court (Mohl, J.) erred by granting the *428defendant’s motion for summary judgment on count IV of his malpractice claim and denying the plaintiff’s motion for summary judgment on count III. The defendant cross-appeals, arguing that the trial court erroneously excluded certain evidence during trial. Because we affirm, we need not reach the merits of the defendant’s appeal.
