This appeal is from a judgment of conviction of the district court of Oklahoma county, rendered on the verdict of a. jury finding the defendant, Art Neff, guilty of manslaughter in the first degree and fixing his punishment at imprisonment in the penitentiary for a term of twelve years.

The information in substance charges that in said county on the 27th day of November, 1925, Art Neff did then and there willfully, unlawfully and feloniously drive a Cadillac brougham car at a high and excessive rate of speed, to wit, approximately 50 miles an hour, along and over Walnut avenue at…
